Can I Airbnb My Brisbane Apartment? | Rules & Body Corporate

Apartment Owners' Guide

Can I Airbnb my Brisbane apartment?

Usually yes, but the building decides more than the council does. Here is how body corporate by-laws, Brisbane's paused council law, insurance and building rules fit together, and the checks to make before you list or buy.

01 · The Short Answer

Yes, in most cases, with two checks to make first

Short stay accommodation is currently permitted throughout Brisbane, including apartments, subject to planning, building and body corporate requirements. No council permit or registration is required today: Brisbane City Council tabled a proposed Short Stay Accommodation Local Law in December 2025 that would have introduced permits for whole-home short stays, then paused it on 12 May 2026. It never came into force.

For apartment owners, the two checks that actually decide the answer are your building's by-laws and your insurance. Both are covered below, plainly.

Keep an eye on the rule book. The paused local law may return in some form before the 2032 Olympics. We track it for our owners as part of management. For the full picture, see our Brisbane Airbnb rules guide.

02 · The Decisive Factor

Body corporate and by-laws

In a Brisbane apartment building, your by-laws matter more than any council rule. They are the building's own rule book, and they vary enormously: some buildings are relaxed about short stay, some regulate guest registration, key and fob access, or the use of shared facilities, and some committees are actively hostile to it.

What a body corporate can and cannot do with by-laws in Queensland is a genuinely nuanced legal area, and the answer for your unit depends on your building's Community Management Statement and by-laws. This is not a page to skim and assume: it is the one check that changes the answer.

Our experience: professionally managed apartments, with screened guests, fast responses and a named local person accountable, rarely generate the complaints that turn buildings against short stay. Most body corporate conflict starts with absent, unmanaged listings.

03 · Council Rules

Where Brisbane's council rules stand

Today: no permit, no registration, no annual fee, and no cap on hosting nights. Brisbane City Council's proposed Short Stay Accommodation Local Law, tabled in December 2025, would have introduced a permit system for whole-home short stays. Council paused the proposal on 12 May 2026, so it never came into force.

Two things remain true regardless. First, standard council rates and charges apply as usual. Second, the proposal could return, and our view is that some form of registration is likely before 2032. Owners with professional operations and clean compliance histories will be best placed whatever arrives.

04 · Planning and Building

Planning, building and the practicalities

Most inner-Brisbane apartments can operate as short stay without planning hurdles, but a few checks are worth making:

05 · Insurance

Insurance: the check owners most often skip

Standard landlord and home insurance policies frequently exclude short-term guests. If you list on Airbnb without telling your insurer, you risk discovering the exclusion at claim time, which is the worst possible moment.

You need a policy that explicitly covers short-stay use, including public liability and guest damage. Airbnb's AirCover is a platform protection program with its own terms and limits; it is not a substitute for proper landlord insurance, and it does not cover everything owners assume it does.

Before your first booking: call your insurer, describe exactly how the apartment will be used, and get the answer in writing. If the policy does not cover short stay, switch to one that does.

06 · Being a Good Neighbour

Guests, noise and amenity

Whatever the by-laws allow, bodies corporate can enforce nuisance and behaviour rules, and neighbours who feel unheard become committees that vote against short stay. The defence is operational, not legal: proper guest screening, clear house rules, fast responses when something comes up, and a local person the building can actually reach.

We give buildings our direct number. In practice, most concerns die in the first phone call, because there is someone accountable on the other end of it.

07 · Buying With Short Stay in Mind

Questions to ask before buying an investment apartment

We are happy to assess a specific apartment before you buy, against current inner-Brisbane market data. An hour of homework here is worth more than any negotiation on price.

08 · Our Process

How we assess apartments for short stay

Every apartment we take on starts with the same honest assessment: location and walkability, building by-laws and access logistics, layout and presentation, parking, and how comparable units are actually performing. Inner-ring apartments are the strongest performers in our market: over the 12 months to July 2026, AirDNA data shows listings in Brisbane City averaged $5,979 a month and South Brisbane $5,692, against a Brisbane-wide average of $6,755.

If the numbers do not stack up for your apartment, we will tell you, and we will tell you why. That advice costs you nothing and commits you to nothing.

09 · Common Questions

Apartment questions, answered straight

Can my body corporate stop me?

It depends on your building's by-laws, and Queensland law here is nuanced. Some by-laws regulate guest registration, common areas and security in ways that affect short stays. Get your by-laws from your body corporate manager, and get advice if anything is unclear.

Do I need council approval?

Not today. No permit or registration is currently required in Brisbane. The proposed local law that would have introduced permits was tabled in December 2025 and paused on 12 May 2026. It never came into force, but it may return.

Is Airbnb legal in Brisbane apartments?

Short stay is currently permitted across Brisbane, apartments included, subject to planning, building and body corporate requirements. Your building's by-laws decide the practical answer, which is why we check them before taking an apartment on.

What insurance do I need?

A policy that explicitly covers short-stay use. Standard landlord policies often exclude short-term guests, and AirCover is not a substitute for real landlord insurance. Tell your insurer exactly how the apartment will be used before your first booking.

Which apartments perform best?

Well-presented inner-ring units: Brisbane City, South Brisbane, Fortitude Valley, Newstead and Spring Hill averaged roughly $4,900 to $6,500 a month over the 12 months to July 2026 (AirDNA). Parking, wifi, air conditioning and layout matter as much as the suburb.

Can I still stay in my apartment myself?

Yes. Block your own dates in the owner portal whenever you like, with no penalty and no permission needed. Many of our owners split the year between their own stays and guest bookings.
